University Press of the South (UNPS), (warning: hideous website alert) is a primarily academic publisher that also accepts adult and children’s fiction. Over the years, I’ve gotten a trickle of advisories from non-academic authors who were asked for substantial fees in order to publish–$2,500 due on contract signing for “administrative costs,” plus the entire cost of printing.

UNPS does not disclose these fees on its website.

Academic vanity presses can serve as a fallback option for scholars who cannot find a more reputable academic publisher for their manuscripts. Academic vanity publishing isn’t prestigious–but it doesn’t carry the same stigma that we’re familiar with in the trade publishing world. Libraries do acquire books from academic vanity presses, and scholars cite them on their CVs.

UNPS is an old-style vanity press. Manuscripts must be delivered camera-ready; UNPS then prints whatever quantity of books the author desires, and the author is responsible for storing and distributing them (unless the author wants to use UNPS’s own distribution service, which costs extra). By contrast, the newer, digitally-based vanity presses offer design and formatting services, don’t produce inventory unless it’s ordered, and automatically offer some level of online distribution through the catalogs of wholesalers. While new-style vanity publishing may never earn back the author’s investment, it’s far cheaper and thus far less risky than old-style vanity publishing, which can involve truly enormous expenditures–and, in some cases, false promises and poor service.

In May 2007, one of UNPS’s authors, Christian Augustin von Hassell, filed suit against UNPS and its Director, Alain Saint-Saens, alleging breach of contract, breach of the duty of good faith and fair dealing, and fraud. According to the complaint, the plaintiff incurred costs in excess of $100,000 in connection with his book (a contract signing fee of $500, an additional signing fee of $2,000, $42,000 to print 6,000 copies, $4,500 to ship copies of the book to UNPS for distribution, more than $34,000 in costs associated with UPNS’s development, distribution, marketing, and promotional services, and thousands of dollars for his promotional and marketing activities). The complaint also alleges that not only did UNPS not provide promised marketing, promotion, and distribution services, it misrepresented its ability to provide them, as well as the scope and functionality of its ordering and distribution system. The plaintiff also alleged that UNPS did not pay royalties due, and refused to allow him to inspect sales records for his book, even though he was contractually entitled to do so.

Alain Saint-Saens and UNPS failed to answer the complaint or otherwise appear. On October 14, 2008, a judgment in favor of the plaintiff was entered in the US District Court of the Southern District of New York, in the amount of $148,449.39: $141,933.07, plus $350 in costs, plus $7,348.49 in interest.

Cheapness Studies: Status and spending acculturation

Helen has an interesting post arguing in part that elite schools are primarily “a training ground for America’s future elite and only incidentally a place to train future intellectuals,” and in light of this, these schools should take more seriously their mission to give “middle-class kids instruction in how to act rich#8212;these habits of self-presentation have as much to do with future success as talent does.”

If we accept that a Yale education is primarily cultural rather than academic, then the kind of acculturation that should take place there depends on what habits we would like our ruling class to have…Yale emphasizes the ways that it broadens students#8217; horizons, but never the ways it narrows them. When Yale offers free fellowships to study in China or subsidizes a trip to New York to catch a Broadway show, it bills these luxuries as instruction in how to be open-minded and well-cultured. In fact, these trips are, more than anything, instruction in how to be wealthy.

When Yale sells these tourist#8217;s-eye-view glimpses as a genuine education in worldliness, it leaves students thinking of themselves as in the ruling class but not of it. Really, they’re just as insular as any elite.

I think there is much to be said for this claim, though I suspect my fellow-cheapsters will disagree, and that it does relate in a narrow kind of way to the problem of thrift. I didn’t attend a particularly exclusive or high-status school by East Coast terms (though it was certainly expensive), but I did attend a school that was, in terms of the students who populated it and what they aspired to, significantly higher class than my prior upbringing. I have no great claims to the standard pre-college deprivations–my family was neither poor nor uneducated, nor were most people I grew up with–but my parents did comment after my second or third year in college that my time there seemed to have influenced my tastes, and not towards greater thrift.

Before college, I had never bought a pair of jeans over $25 and I thought Starbuck’s was where the rich drank their fancy, inscrutable cocktails. In college, I still liked that sentiment, but a real “deal” was a pair of $70 jeans marked down to $40, not the shapeless, stretchy $25 ones from Target. Clearly this attitude shift was not the result of a higher income–I was just as poor in college as before it, and more if I considered the cost of my education as personal debt, which I mostly did not. I’m pretty certain that some combination of my friends’ spending habits and the sense of status-raising promise (probably entitlement) that everyone at Chicago imbibed dramatically changed my own expectations about money and how to spend it in a way very similar to the kind of class acculturation Helen describes. I still wanted to be thrifty, but I desperately did not want to be trashy, which I took to be anything lower class than the class our graduation from Chicago implied we would join. (Do you see how ambiguous this status game is? Status acculturation seems to go hand-in-hand with status anxiety. Endlessly elusive and self-absorbing.) I wanted to live in a way that anticipated how I expected to live once all the promises of my expensive education were borne out and I was 45 and paid private school tuition for my children and owned a row-house in Lincoln Park, where I walked my labradoodle.

Of course there were obvious limitations to what could be done, and everyone at the same time relished the image of their faux-poverty by eating at places like Depot and decorating their apartments with curbside furniture finds (this was before the Great American Bedbug Infestation). But that was all for ironic show. The real thrift, such as there was in college, was channeled into finding a good price on a nice interview suit that would last a few years. (Miss Self-Important hadn’t gotten that far in the acculturation process yet though, and decided that buying the pieces separately at two different sales would be wiser. This proved false. Now her suit does not match.)

This status acculturation process continues apace after college, where I live in comfortable entry-level with no dependents affluence. Recently, a friend sent me an invitation to Gilt, which sends me daily sales on designer clothes I would never buy. They are substantially discounted, but only in the sense in which a previously $800 dress on sale for $250 dollars can be considered to be discounted. Nonetheless, I look at the sales each day, and I am starting to believe that maybe a $160 dress, marked down from $425, is not such a bad deal. After all, I have seen them every day for weeks already and these are the cheapest of the cheap. To which my friend Alex replies, “I think it’s a reasonable amount for a nice dress, but more than you would have spent a few months ago. This is how people get acclimated to spending money such that the NYTimes articles about discount designer shopping become relevant to you.” That’s terrible, I reply. “Yeah, I stopped looking.”

South Florida Lawyers: Herman Russomanno Is Delighted.


How many times can one guy be delighted in a single soundbite:

Rivkind, Sotolongo and Wingate drew up the fee-splitting arrangement in February 2008, about a month after Wingate dropped his case portfolio, according to Stettin#8217;s order.

#8220;I conclude that it is a secret, self-serving and illegal arrangement intended as a means of evading this court#8217;s order concerning Wingate#8217;s claim to fees and costs from files which he abandoned,#8221; Stettin wrote in an order issued late Monday.

The judge said there was no evidence to suggest that Rivkind had defied the court by entering into a fee arrangement that Stettin had barred.

#8220;We#8217;re delighted that Judge Stettin made the express finding that the Rivkind law firm did not engage in any conduct in violation of a court order, and we#8217;re delighted that the judge did not find Mr. Rivkind in contempt,#8221; said Rivkind#8217;s attorney, Herman Russomanno of Russomanno amp; Borello in Miami.

Peter Sotolongo, not so much:

But the judge slammed Sotolongo. Stettin wrote that the lawyer#8217;s #8220;misconduct was compounded by his false, misleading testimony#8221; during a Jan. 15 deposition.

During the deposition, Sotolongo estimated he received about $20,000 under the fee-splitting arrangement. But Stettin concluded the actual amount was about $114,000 after he examined fee agreement contracts in 27 cases. The judge on Tuesday ordered the attorneys to send their fees to the court clerk#8217;s office.

#8220;The disparity is too large to suggest it was simply a memory lapse,#8221; the judge wrote. #8220;Sotolongo#8217;s lack of candor is not attributable to simple negligence or a bad memory.#8221;

The judge held Sotolongo, who was Wingate#8217;s associate, and Wingate in contempt. Stettin noted he was referring the matter to The Florida Bar for investigation.

Oy.

Judge Stettin should be enjoying his retirement, instead he’s got a crazy case like this to preside over? And I have a sneaking suspicion this whole mess is not quite over.

Dubai Media Observer: Return of the media mack daddy

Another Dubai media behemoth rises again …. Former ITP sales god Neil Petch is now managing director of ENG Media, formed by Emirates Neon. He has poached Graham Stacey from CPI (where he headed up OK Middle East), who is now group editor.

Details on what publications they plan to launch are sketchy at best, but our money is on a celeb gossip title at least. Our spies tell us that Stacey is on a serious recruitment drive.

Two weeks ago, I was at lunch with 4 of my coworkers/peers at FederalEntity. We#8217;re all bright, hard-working 20-somethings who have been stuck at FederalEntity for the past 2.5 years or so. As we ate, we went around the table taking turns describing how we felt trapped. Each one of us has been looking for a new job for at least the last 8 months, in some cases (me) much longer than that. We#8217;ve all been presented with amazing opportunities within FederalEntity (rotations, new jobs, grad school classes, increased responsibilities, etc.) and we#8217;ve all then had these opportunities ripped away from us at the last minute. In essence, we#8217;ve all been screwed by the system.

The main theme of lunch that day was clear: we all want out, but#8230;

It#8217;s like there#8217;s some weird unknown force that#8217;s keeping us stuck here. Judging by my older co-workers who have been here for 20-30 years, this place is like being caught in quicksand. Every #8220;lifetime#8221; Fed says the same thing #8211; they came in thinking they#8217;d try Government work for a few years, and next thing they knew 30 years had flown by and they were still here!

The Government is tricky like that. You come in when you#8217;re young and you don#8217;t get paid that much. But the work/life balance is great and every year you get an automatic 8-12k raise. After 5 years you realize that you#8217;re grossly overpaid but have no relevant skills that would help you to make the same salary in the private sector. Then it#8217;s decision time: you#8217;re in your late 20#8217;s getting paid lots to do very little #8211; do you give it up to go to the private sector (doing more work for less $), or do you keep coasting on the Federal wave for the next 25 years and then retire?

I keep telling myself there#8217;s NO WAY I#8217;ll stick around here forever, but (cliché) that#8217;s literally what they all say#8230;

Who from the lunchtime group will escape and who will get trapped? At this point, it’s unclear. Now its crunch time for all of us – in a year, it#8217;ll be too late. We#8217;ll be stuck like mice on a glue trap.

My 3-year anniversary is in June. I know one thing for certain: if I make it through year 4, I#8217;m toast.
